All notifications and communications between users and Encaja Embalajes de madera S.L. will be considered effective, for all purposes, when carried out through any of the means detailed above.

  1. ACCEPTANCE OF THE CONDITIONS

The client accepts the conditions of sale and delivery, as well as our particular conditions.

  1. RECEIPT OF THE GOODS

It is a condition that at the time of receipt of the merchandise, indicate on the delivery note any incident that may have and notify Encaja Embalajes de madera S.L. or by email administracion@encaja.org within 24 hours of receiving the order. If the shipment suffers significant damage, it must be rejected and Encaja Embalajes de madera S.L. must be notified as soon as possible.

Delivery times are approximate unless expressly agreed in writing with Encaja Embalajes de madera SL The customer will not have the right to request the cancellation of an order or any compensation (including the return of freight) in case of a delay in the delivery of the product. The customer may not refuse to pay the price of the products already delivered when there is a partial delivery of an order by Encaja Embalajes de madera S.L.

Encaja Embalajes de Madera S.L. will try to meet and supply product orders within the time agreed with the client, as long as their resources and production capacities allow it.

  1. RISK TRANSFER

The risk of loss and / or damage is transferred to the customer from the moment the merchandise is shipped to the customer.

  1. RETURN AND CANCELLATION POLICY

The customer will have 14 days from receipt of the product to request Encaja Embalajes de Madera S.L any claim in relation to the product. After this period, the products will be considered compliant by the customer. Claims must be made via email administracion@encaja.org or by phone 9685669270 . Encaja Embalajes de Madera S.L is not responsible and reserves the right to reject possible returns in case of merchandise in poor condition or misuse or damage in transit.

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without the need to indicate the reason and without incurring any cost, except those provided for in articles 107.2 and 108 of RD1 / 2007, of November 16, which approves the aforementioned text of the General Law for the Defense of Consumers and Users.

This right of cancellation does not apply, among other things:

  • Provision of services already executed or started.
  • Contracts for the supply of goods whose price is subject to fluctuations in the financial market ratios that the entrepreneur cannot control.
  • Contracts for the supply of products made according to the specifications of the consumer and user or clearly personalized, or that by their nature cannot be returned or may deteriorate or expire quickly.
  • Supply of sealed products that cannot be returned for health or hygiene reasons.
  • Supply of goods that after delivery have been mixed with others.
  • Contracts through public auctions.

SERVICES
The term to withdraw from the contract for the provision of services is 14 calendar days from the day of the contract, and the user must inform Encaja Embalajes de madera S.L. of your desire to exercise this right, which you can do by completing the form at the end of this document.

The exercise of the right of withdrawal will lead to the suspension of the service.

Encaja Embalajes de madera S.L. will communicate to the consumer in a durable medium an acknowledgment of receipt of said withdrawal.

The withdrawal implies that Encaja Embalajes de madera S.L. will proceed to refund the amount already paid by the client within a maximum period of 14 calendar days, following the same procedure chosen by the client for payment (provided that the contracted service is not within the exceptions indicated above ).

Once we receive your request, we will contact the customer to indicate the details of the return.

  1. LIABILITY AND DISCLAIMER

Encaja Embalajes de madera S.L. may suspend, withdraw or partially or totally cancel the contracted services at any time and without prior notice. The previous provision will not affect those services that are reserved for registered users or that are subject to prior contracting and that will be governed by their particular conditions.
